A wrongful death lawsuit was filed today in Madison Circuit Court, Division II. The plaintiffs are C. Wesley Morgan individually, C. Wesley Morgan as executor of the Estate of Jordan Wesley Morgan, and C. Wesley Morgan as parent and next friend of Sidney L. Morgan, his minor child.
The defendants in the wrongful death lawsuit are Shannon Gilday and Katie Gilday, the mother of Shannon. The lawsuit also names ten other unidentified parties as defendants.
On February 22, 2022 Shannon Gilday unlawfully broke into the home of Wesley Morgan on Willis Branch Road in Richmond. After invading the home, Gilday shot and killed Jordan Wesley Morgan. Gilday is currently in the custody of the Madison County Jailer at the Madison County Detention Center. The lawsuit is asking the court to appoint a guardian ad litem for Gilday.
The lawsuit also states Katie Gilday participated in the activities and assisted in the detailed planning of the invasion of the Morgan home. Furthermore, the lawsuit states Katie Gilday should have informed one or more police agencies about her son’s plan.
The plaintiff, Morgan, is making a claim individually for injuries he sustained from being shot by Gilday; a claim for the wrongful death of his daughter, Jordan Wesley Morgan, and a claim for personal injuries to his minor daughter, Sidney L. Morgan, who was shot and injured by Shannon Gilday. The plaintiff is seeking compensatory damages and punitive damages for all parties involved in the lawsuit.
