The prosecution team in the case of Shannon Gilday have recused themselves. That according to the Lexington Herald today. Gilday is on trial for the 2022 Madison County home invasion that took the life of 32-year-old Jordan Morgan, and shooting and injuring her father, former lawmaker Wesley Morgan, in an ensuing shoot out. The case will now be led by special state prosecutors.
Gilday, 25, faces charges of murder, assault, three counts of attempted murder, burglary and criminal mischief for the crime.
David Smith told the Herald-Leader there were several reasons for the recusal, which came after discussions between him and Wesley Morgan, but no specific details were disclosed.
The prosecution change came just weeks before a crucial court hearing regarding Gilday’s mental health that could determine if he could receive the death penalty.
The shooting and home invasion occurred almost 3 years ago on Feb. 22, 2022.
Investigators say Gilday, who had developed an obsession with the homes extensive ‘dooms day bunker facilty” below ground, He spent extensive time to case the premises for days before breaking into the multi-million-dollar home of Wesley Morgan on Willis Branch Road in Richmond,
Gilday’s lawyers have tried to get the death penalty off the table based on his psychological evaluations, but it is something the family strongly advocates and may have played a role in the prosecutorial change.
